TERMS & CONDITIONS

1. Acceptance of Terms

By accessing or using the Service you confirm that you have read, understood, and agree to these Terms and our handling of data as described herein. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

2. Eligibility

You must be at least 13 years old (or the minimum age required by your jurisdiction to form a binding contract) to use the Service. Users under 18 must have the consent of a parent or guardian. You are responsible for ensuring that your use of the Service complies with all laws and regulations applicable to you.

3. Accounts and Security

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify us promptly of any unauthorized use of your account or any other security breach.
• We are not liable for any loss or damage arising from your failure to safeguard your credentials.
• You may not create accounts by automated means, create multiple accounts for abusive purposes, or impersonate any person or entity.

4. Licenses and Permitted Use

• The Service grants you a limited, non-exclusive, non-transferable, non-sublicensable right to access and play games within the scope of your current account entitlements (free tier, active subscription tier, or individual purchase), on the web or through the authorized desktop application.
• Access to a game is tied to your account. You may not share your account, sell or transfer individual game access, or use technical means to access games beyond your entitlements.
• The desktop application (GNL://ARCADE) is licensed for personal, non-commercial use on devices you own or control. You may not redistribute, sublicense, or reverse-engineer the application.
• We reserve the right to suspend or revoke access that we reasonably believe is being used in violation of these Terms.

5. Fees, Billing, and Subscriptions

• Prices are stated at the point of purchase and are exclusive of taxes unless otherwise noted. You are responsible for all applicable taxes.
• Subscriptions renew automatically at the end of each billing period at the then-current rate, unless cancelled before the renewal date. Your subscription tier determines which catalog of games you may access during the active period.
• One-time game purchases grant permanent access to the specific game purchased, independent of any subscription status.
• Plan changes and retirement. We may add, modify, re-price, or retire subscription tiers at any time. If a tier you subscribe to is retired, you retain the access you have paid for through the end of your then-current billing period; before that period ends you may choose a then-current plan, and if you do not, your account moves to the free tier at the end of the paid period. No refund — partial or full — is owed for a tier change or retirement.
• By providing a payment method you authorize AideaMaker and its payment processors to charge the applicable fees, including recurring renewal fees, to that method.
• Payments are processed by Stripe. Your use of Stripe is subject to Stripe's own terms and privacy policy.

6. No Refunds

All sales are final. There are no refunds. This applies to both one-time game purchases and subscription payments. Cancelling a subscription stops future renewals but does not entitle you to a refund — partial or full — for the current or any prior billing period. Fees paid are non-refundable to the maximum extent permitted by applicable law.

7. Cancellation and Termination

• You may cancel a subscription at any time from your account settings. Cancellation takes effect at the end of the current paid billing period; no refund is provided for the remaining time.
• Permanently purchased games remain accessible to your account unless your account is terminated for a Terms violation.
• AideaMaker may suspend or terminate your account at any time for any violation of these Terms or conduct we reasonably believe is harmful to the Service, other users, or AideaMaker.
• Upon termination, your right to access the Service and any games ceases immediately. Sections on fees, disclaimers, limitation of liability, and indemnification survive termination.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful, infringing, defamatory, or fraudulent purpose.
• Attempt to gain unauthorized access to any game, account, or system beyond your entitlements.
• Reverse-engineer, decompile, extract, or tamper with the desktop application, any game bundle, or any access-control or authentication mechanism.
• Automate access to the Service, scrape game content, or circumvent any rate limits, access checks, or DRM.
• Post or upload content that is unlawful, defamatory, harassing, hateful, obscene, or that infringes any third party's rights.
• Resell, redistribute, or commercially exploit the Service, games, or any portion thereof, except as expressly authorized in writing.

8A. Game Idea Submissions

If you submit an unsolicited game idea, concept, pitch, or feature suggestion to AideaMaker through the Service's contact form, the forum, or any other channel, and you do not already own a copyrighted work or patent that covers that idea:

• You grant AideaMaker a worldwide, perpetual, royalty-free, non-exclusive, sublicensable license to use, evaluate, develop, publish, and commercialize that idea in any form and without obligation or further notice to you.
• If AideaMaker develops and publishes a game substantially based on your submitted idea, AideaMaker will, in its sole discretion and as its sole obligation: (a) consult with you further on the concept; (b) provide a non-monetary contribution credit in the game's internal metadata or credits page; and (c) provide you with a complimentary copy of the finished game.
• AideaMaker is under no obligation to implement, acknowledge, notify you of, credit you for, or compensate you for any submitted idea. Submission of an idea creates no employment, agency, partnership, or joint-venture relationship.
• Ideas are not treated as confidential. AideaMaker may freely use the information in submissions without restriction. You acknowledge that similar ideas may be independently conceived by others.
• You represent that your submission does not contain any confidential information of a third party, does not violate any non-disclosure or non-compete obligation, and that you have the right to make the submission on the terms above.

9. Creator Uploads and User-Generated Content

• You retain ownership of game bundles and other content you submit ("User Content"), but you grant AideaMaker a worldwide, non-exclusive, royalty-free license to host, store, reproduce, distribute, and display that content solely as needed to operate and provide the Service.
• You represent and warrant that you own or have the necessary rights to all User Content you submit, that it does not infringe any third party's rights, and that it complies with all applicable laws.
• You are solely responsible for the accuracy, quality, legality, and appropriateness of your User Content.
• Game submissions are subject to admin review and approval. AideaMaker reserves the right to accept, reject, remove, or modify any submission at its sole discretion, without notice or obligation.
• We respond to valid intellectual-property infringement notices. Repeat infringers' accounts may be terminated.

9A. Annoying Features — Guarantee and Acknowledgement

Every game published on the Service is produced with the intention — and may contain the reality — of multiple minorly annoying features designed to irritate players in small but persistent ways. By using the Service you acknowledge and accept that:

• Game annoyances are intentional and are not defects eligible for refund or support escalation.
• AideaMaker makes no warranty that any particular annoyance will bother you specifically; results will vary.
• Requesting the removal of an annoying feature is considered feedback and is neither acknowledged nor acted upon.

9B. Gift Credits

• Gift credits ("Store Credit") are issued to your account upon successful payment for a gift-credit product. Credit is applied automatically at the time of purchase.
• Store Credit has no cash value, is non-refundable, non-transferable, and cannot be redeemed for cash.
• Store Credit may be applied toward the purchase price of individual games. It may not be used toward subscriptions or other recurring charges.
• All gift-credit sales are final. The price you pay and the credit amount you receive are determined at the time of purchase and may differ — this is intentional and acknowledged by you.
• AideaMaker reserves the right to expire or revoke Store Credit upon account termination for a Terms violation.

9C. AI-Generated Forum Content

The Service's "AI Complaint Processing" forum category uses automated AI to generate replies to user posts. These replies are:

• Produced by an automated system and do not represent the views, commitments, or official responses of AideaMaker.
• Not legally binding and should not be relied upon as advice, support, or acknowledgement of any complaint or claim.
• Subject to the same acceptable-use rules as all other forum content; admins may remove AI-generated posts that violate these Terms.
• Generated by sending your post text to a third-party AI provider solely to produce the reply (subject to Section 13, Third-Party Services). Do not submit confidential, sensitive, or personal information you do not want processed this way. AI features may be unavailable when no provider is configured or reachable.

10. Forum and Community Conduct

• The Service includes a discussion forum where users may post messages, threads, and replies ("Forum Content"). Forum Content is User Content subject to Section 9 above.
• You agree not to post Forum Content that is spam, off-topic, misleading, harassing, hateful, or that promotes illegal activity.
• AideaMaker may moderate, remove, or lock Forum Content at its discretion. We are not responsible for any Forum Content posted by other users.

11. Intellectual Property

The Service — including the website, desktop application, game catalog (where rights are held by AideaMaker), designs, text, graphics, logos, and branding — is owned by AideaMaker or its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in any of the foregoing. Creators retain rights in their submitted games subject to the license granted in Section 9.

12. Privacy and Data

• We collect and process the account, payment, and usage information necessary to provide the Service, manage entitlements, and process payments.
• For security, billing, ownership, and support purposes we maintain an operational audit log of important account and transaction events — such as game and installer downloads, purchases and payments, subscription changes, manual entitlement grants or revocations, administrative configuration changes, account registrations, and content publication or removal — together with the acting account and the originating IP address. This audit log is accessible only to administrators, is retained on a limited, rolling basis (oldest records are automatically removed), and never stores passwords, full payment card numbers, or other secret credentials.
• Payment ledger is permanent and immutable. Every payment-related event (purchase, subscription charge, gift-card issuance and redemption, refund, dispute) is recorded in an append-only, hash-chained payment ledger and is never modified, scrubbed, anonymised, or deleted under any circumstances. This is a financial-record-keeping requirement and overrides any general retention or pruning rule elsewhere in these Terms or the Service.
• Application data retention. Certain operational application records are subject to automatic deletion after a fixed period: contact form submissions are retained for 18 months; bug reports are retained for 24 months; game bundles submitted for review but not approved within 30 days are automatically removed. These windows apply only to the named application tables and do not affect any user account, purchase, forum post, session, or financial record. The payment ledger described above is explicitly excluded from all retention or pruning rules and is never deleted.
• Payment card data is handled directly by Stripe and is not stored by AideaMaker.
• We implement reasonable security measures, but no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12A. United States Jurisdiction; No GDPR or Foreign Data-Rights Support

• The Service is designed for, operated from, and intended to be used inside the United States. It is provided under United States law (see Governing Law and Disputes below) and is not designed, configured, or marketed for users in the European Union, the European Economic Area, the United Kingdom, or any other jurisdiction whose data-protection laws (including, without limitation, the EU General Data Protection Regulation ("GDPR"), the UK GDPR, the UK Data Protection Act, the EU ePrivacy Directive / PECR, and any comparable foreign regime) would purport to grant data-subject rights against AideaMaker.
• AideaMaker does not offer, and is under no obligation to provide, the data-subject rights established by the GDPR or any comparable foreign data-protection regime. This includes, without limitation: the right to erasure ("right to be forgotten"), the right of access in the GDPR-specified form, the right to data portability, the right to restriction of processing, the right to object to processing, the right to withdraw consent in the GDPR-specified form, and the right to lodge a complaint with a supervisory authority. Nothing in these Terms is a representation that any such right applies to your use of the Service.
• Account closure does not delete account data. Your account, profile, forum posts, audit-log entries, and — without exception — every entry in the payment ledger described above are retained for the operational, legal, tax, anti-fraud, and financial-record-keeping reasons set out in these Terms. Cancellation of a subscription, deactivation, or disuse of the Service does not trigger deletion. Requests to delete account data, scrub historical records, or alter the payment ledger will be refused.
• Your decision to use the Service. Whether you need GDPR (or any equivalent foreign) data-protection protections, and whether to use the Service anyway knowing those protections are not offered, is entirely your own decision. AideaMaker does not block, screen, or geofence users by jurisdiction. By accessing or using the Service you acknowledge that you have made that decision yourself, that you are not relying on the protections of the GDPR or any comparable foreign data-protection regime in your use of the Service, and that you waive any such protections to the maximum extent permitted by law. If, after reviewing this section, you conclude that you do require those protections, the appropriate course is simply not to use the Service.
• The United States resident-facing rights AideaMaker does honour are set out elsewhere in these Terms (account profile editing, password change, subscription cancellation, support contact through the form referenced in the Contact section). These US-resident rights are the only data-handling rights the Service supports.

13. Third-Party Services

The Service integrates with third-party providers, including Stripe for payment processing and hosting infrastructure providers. We are not responsible for the availability, accuracy, or conduct of any third-party service, and your use of those services is governed by their own terms and policies.

14. Desktop Application and Downloadable Games

• The GNL://ARCADE desktop application may periodically contact AideaMaker servers to verify your account authorization. If verification cannot be completed, certain features may be limited until connectivity is restored.
• Games downloaded for offline play via the desktop player may only be used through the authorized application. You may not extract, copy, or redistribute downloaded game files.
• Standalone Windows executables. Certain games are delivered as native Windows .exe installers rather than as browser-playable bundles. You may download a standalone executable only if you hold a valid, current entitlement to that game (active purchase, active subscription at the required tier, or a free-game grant). The executable may contact AideaMaker servers to verify your entitlement on launch; if verification cannot be completed, the game may remain accessible for a limited offline grace period based on the last successful verification. The grace period is not a guarantee of continued access.
• No redistribution of executables. Download links for standalone Windows games are generated specifically for your account and expire shortly after creation. You may not share, copy, post, or redistribute a download link or the downloaded file to any other person.
• Standalone Windows games are independent of the GNL://ARCADE desktop player application; they install and run directly on your Windows system.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. GAME CONTENT IS VARIED IN NATURE AND QUALITY — WE MAKE NO WARRANTY AS TO THE ENTERTAINMENT VALUE, COMPLETENESS, OR FITNESS FOR ANY PURPOSE OF ANY PARTICULAR GAME.

The Service may be in active development; features described may not yet be fully available, may change, or may be discontinued at any time without notice.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AIDEAMAKER OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. AIDEAMAKER'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO AIDEAMAKER FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

17. Indemnification

You agree to indemnify, defend, and hold harmless AideaMaker and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your use of the Service; (b) your User Content or Forum Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

18. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be posted with an updated effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

19. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which AideaMaker is established, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in that jurisdiction, and you consent to their personal jurisdiction.

20. Severability and Waiver

If any provision of these Terms is held to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.

21. Entire Agreement

These Terms constitute the entire agreement between you and AideaMaker regarding the Service and supersede all prior agreements and understandings.
